Terms of Service

Property Pioneers operates in New Zealand and provides Pioneers OS, a property management and franchise operations platform. The platform helps authorised users manage property deals, pipelines, buyers, financial reporting, compliance reviews, documents, and related franchise operations.

Information in Pioneers OS is provided for authorised business use only. It does not constitute legal, financial, tax, or investment advice. You are responsible for your own business decisions and for verifying property, financial, and compliance information independently.

Pioneers OS is intended for authorised business users aged 18 or older. Access is typically granted by invitation or account provisioning by Property Pioneers or your franchise organisation. By using the platform, you confirm that you:

• Are legally capable of entering binding agreements
• Have been authorised to access Pioneers OS
• Will provide accurate registration and profile information
• Will keep your login credentials confidential

You must not share your account with others or allow unauthorised persons to access the platform using your credentials.

Pioneers OS provides role-based access, which may include franchisees, incubators, regional managers, and headquarters administrators. Features available to you depend on your assigned role.

Some users (such as regional managers or HQ administrators) may have visibility into franchisee data or use authorised oversight features (including “view as” access) within the scope of their role. You must only access, view, and use data you are permitted to access under your role and organisational policies.

When using Pioneers OS, you agree not to:

• Use the platform for unlawful, misleading, or fraudulent purposes
• Copy, scrape, reproduce, or redistribute platform content, data, or software without permission
• Attempt to bypass security, access controls, or authentication measures
• Interfere with or disrupt the platform, servers, or networks
• Upload malicious code, unlawful content, or material you do not have rights to use
• Misuse integrations (such as Gmail or Google Drive) to send spam or unauthorised communications
• Enter personal information about third parties (such as buyers or enquiries) unless you have a lawful basis and, where required, their consent

You are responsible for the accuracy of information you enter into the platform, including deal data, buyer details, notes, documents, and financial figures.

Pioneers OS may include features such as:

• Property deal and pipeline management
• Buyer and enquiry tracking
• Financial, capital, and reporting tools
• 3P Review and compliance workflows
• Site diary, document uploads, and notifications
• Property lookup via third-party data providers (such as Relab)
• Optional integrations with Gmail and Google Drive when you choose to connect them

Optional integrations are provided for your convenience. By connecting them, you authorise Pioneers OS to access and use those services only as needed to provide the connected features. You can disconnect integrations from your profile settings.

We may modify, suspend, or discontinue features at any time, with or without notice, where reasonably necessary for maintenance, security, legal compliance, or product improvement.

Pioneers OS relies on third-party services to operate, including authentication, hosting, storage, email delivery, property data providers, and connected Google services.

Your use of third-party services may also be subject to their own terms and policies. We are not responsible for third-party services outside our control, including outages, data accuracy from external property providers, or actions taken through your connected Gmail or Google Drive accounts.

All software, branding, design, text, graphics, workflows, and other content in Pioneers OS are owned by or licensed to Property Pioneers and are protected by applicable intellectual property laws.

You receive a limited, non-exclusive, non-transferable right to use Pioneers OS for authorised business purposes while your account remains active and in good standing.

You retain ownership of content you upload, but grant us a licence to host, store, process, and display that content solely to operate and provide the platform (including syncing deal documents to Google Drive where you enable that feature).

You may have access to confidential franchise, deal, buyer, financial, and operational information through Pioneers OS. You agree to use such information only for authorised business purposes and to comply with any applicable franchise agreements, employment terms, and organisational policies.

We may suspend or terminate your access to Pioneers OS if you breach these Terms, misuse the platform, pose a security risk, or if your authorisation to use the platform ends (for example, when your franchise relationship ends).

You may stop using the platform at any time. Upon termination, your right to access Pioneers OS ends, but sections that by nature should survive (such as liability limits, intellectual property, and governing law) will continue to apply.

Pioneers OS is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including fitness for a particular purpose, accuracy, completeness, and uninterrupted availability.

We do not guarantee that property data, valuations, financial calculations, reports, or compliance outputs are error-free or suitable for your specific circumstances.

To the fullest extent permitted by New Zealand law, Property Pioneers and its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, business opportunity, or goodwill arising from your use of Pioneers OS.

To the extent liability cannot be excluded, our total liability for any claim relating to the platform is limited to the greater of NZD $100 or the amount you paid us for access to Pioneers OS in the 12 months before the event giving rise to the claim (if any).

Nothing in these Terms limits rights or remedies that cannot be excluded under New Zealand law, including under the Consumer Guarantees Act 1993 where it applies.

Your use of Pioneers OS is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information under the Privacy Act 2020 (New Zealand). See the Privacy Policy link at the top of this page.

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of Pioneers OS after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of New Zealand. You agree to submit to the non-exclusive jurisdiction of the New Zealand courts.
